AB Der Autor untersucht die Textgschichte der cann. 1598 und 1614-1615 vom CIC/1917 über die Codex-Reformarbeiten bis zum CIC/1983. Leitend ist für ihn das Dilemma zwischen dem Recht der Prozessparteien auf Akteneinsicht und dem Recht auf Verschwiegenheit, welchem letzterem besonders in den Eheprozessen ein hoher Stellenwert zukäme. Besonders die Praxis der US-amerikanischen Tribunale weiche oftmals aufgrund zu befürchtender zivilrechtlicher Prozesse stark von der im CIC/1983 vorgeschriebenen Praxis ab und gefährde damit die Gültigkeit des Verfahrens
