Per poter "ius-dicere" e garantire "la razionale e normale applicazione" della Legge, il il retto esercizio della sua azione e gli consentano di svolgere il proprio compito con competenza, maturtià ed equilibrio. Il Vescovo diocesano può esercitare la potestà giudiziaria personalmente o tramite altri; secondo il disposto del Can. 1420, è tenuto a costituire il Vicario giudiziale e i Giudici diocesani. Quella del Giudice ecclesiastico è una potestà ordinaria-vicaria; non è una professione, ma un ministerio che richiede professionalità e zelo. Nella persona del Giudice devono fondersi armonicamente operando in sinergia: formazione umana, professionale ed ecclesiale. Nella sua azione di "ius-dicere", un Giudice ecclesiastico, deve perseguire il primato della verità mediante la ricerca oggettiva di essa e la fedeltà nell'applicazione delle Norme processuali. Il Giudice ecclesiastico è tale non perché giudica in materia ecclesisastica in nome della Chiesa e secondo la dottrina e la Legge della Chiesa. The word "Judge", from the Latin "ius-dicere", literally means "to say the right". In order to "ius-dicere" and ensure "the rational and normal application" of the Law, the Judge must not only have scientistic requirements, but also the suitable kindness to guarantee his good action and enable him to perform his role with expertise, maturity and poise. The diocesan Bishop can exercise judicial power personally or through others; according to Can. 1420, he is responsible for appointing the judicial Vicar and the diocesan Judges. The authority of the ecclesiastical Judge is an ordinary-vicarious power; in the person of the Judge, human, vocational and ecclesial education must blend together harmoniously by working in synergy. An ecclesiastical Judge, in his assignment of "ius-dicere", must pursue the primacy of Truth through his authentic research for the same and his accurancy in applying the procedural rules. The ecclesiastical Judge is such not because he judges in ecclesiastical matters, but because he judges in the Church's name and according to the doctrine and Law of the Church. | ||
