A mezzo secolo dalla Dichiarazione "Dignitas Humanae", questo studio propone una verifica di quell'audace "atto di fede" die padri conciliari attraverso l'esame critico della Giurisprudenza della C.E.D.U. di Strasburgo. L'autore mostra come ed in quale misura le principali rivendicazioni della Chiesa cattolica in materia di libertà e di autonomia isitituzionale, formalizzate principalmente nel CIC 1983 e nel CCEO 1990, trovano una tutela nella Giurisprudenza che garantisce il rispetto della Convenzione Europea, specie dell'Art. 9 sulla libertà di pensiero, di coscienza e di religione. Entrano innanzitutto in considerazione la personalità giuridica, le nomine, la farmazione die futuri Ministri, L'annuncio della dottrina, l'istruzione, la giuridizione nell'ambito ecclesiale, la capacità patrimoniale, la potestà giudiziara e di sanzione amministrativa, la sovranità della Santa Sede, etc. The Second Vatican Council holds that there is a "harmony" between libertas Ecclesiae and the fundamental right to religious liberty, including ist community dimension. Half a century after the Declaration "Dignitas Humanae", this study proposes to verify hat bold "act of faith" by the council fathers through a critical examination of the jurisprudence of the E.C.H.R. in Strasbourg. The author shows how and what extent the principle claims of the Catholic Church in matters of liberty and institutional autonomy, pincipally formalized in CIC 1983 and in CCEO 1990, find protection in the Jurisprudence which guarantees respect of the European Convention, specifically in Article 9 on the freedom of thought, conscience, and religion. Considered in particular are juridical personality, nominations, formation of future ministers, spreading of doctrine, instruction, jurisdiction in the ecclesial realm, control over property and goods, judicial and administrative power, the sovereignty of the Holy See, etc. | ||
