Algunas han sido constituidas directamente por institutos religiosos. Los que no son titulares de la potestad de régimen han de contar con la intervención del ordinario del lugar (de la Conferencia episcopal, si pretendiera constituirse una fundación canónica de ámbito nacional). Algunos institutos religiosos, sin embargo, han procedido a la creación de fundaciones civiles para continuar desempeñando sus actividades propias. A la vista de las dudas canónicas que están surgiendo en torno al fenómeno, la Conferencia Episcopal Española ha establecido unos criterios básicos sobre el régimen de fundaciones canónicas privadas y ha creado un Consejo Episcopal de Fundaciones Canónicas para ejercer el protectorado. | ||
